Terms and Conditions
These Terms and Conditions apply to all services provided by Cre8ive Works Ltd (“We”, “Us”, “Our”) to the Client (“You”, “Your”). By engaging our services, requesting a quotation, making payment, or continuing to use our services, you are deemed to have read, understood, and accepted these Terms and Conditions in full.
1. Contract Term
All website design, hosting, management and social media services are subject to a minimum 12-month contract. By entering into this agreement, you commit to a one-year service term from the commencement date. Early termination will require payment of the remaining contract balance in full. By signing up you automatically agree to our minimum contract term length.
2. Updates to Terms and Conditions
Update effective 01/08/2025 – Domain Transfer Policy: If you choose to transfer your domain name before the end of your 12-month contract, the following conditions apply:
- Outstanding Balance: The full remaining balance of your contract must be paid before the domain can be released. For example, if you are on a 12-month plan and have paid 4 months, the remaining 8 months must be paid in full.
- Transfer Fee: An £80 transfer fee is payable. This covers administration, liaison with your new provider, and the technical release of the domain.
Domains will only be released once the balance and fee have been settled.
Domain Transfer policy
In the event that the client wishes to transfer their domain, whether to the same service provider or to a new service provider, the transfer will only be processed once a direct telephone conversation has taken place with the new website designer. This is to ensure that the transfer is properly coordinated, that all technical requirements are managed by both parties, and that the continuity of service is maintained. Until such communication has occurred, no domain transfer request will be accepted and services will resume as normal.
Upgrade to SEO services as of 01/08/25 - Any upgrade to SEO services is a minimum of three months contract length. This is to ensure an effective impact in work.
Update effective 23/03/2023 – Hosting Provider Restrictions: Our hosting provider currently does not permit websites to be transferred to another hosting platform. This is expected to be temporary, and terms will be updated when resolved. Until then:
- Websites cannot be transferred or accessed directly.
- Login details cannot be provided.
- Pay-monthly clients may move to a hosting-only package after 12 months.
- If you choose to leave, a new website must be commissioned from another provider.
3. Services
Hosting
Your website is hosted via a third-party provider, managed by us.
Design
Design is included in package prices at our discretion, ensuring suitability for your website’s purpose. Premium package clients may request a full redesign after three years.
Management
We provide a managed service, including updates, security, and performance monitoring. Updates must be requested with clear instructions and required content.
- Basic packages include up to 2.5 hours of updates per month.
- Premium packages include up to 5 hours of updates per month plus eligibility for a redesign after three years.
- Unused hours do not roll over.
Website Redesigns
Redesigns are not included unless you qualify under the premium package terms. Redesigns requested earlier will incur additional costs.
4. Payment Terms
- Charges are set out in your quotation (valid for 60 days).
- The first month’s payment is due before work commences.
- Payments are collected monthly via our secure merchant service.
- Cancellations require 30 days’ written notice but cannot be made before the minimum 12-month term ends.
- Simply cancelling a recurring payment does not constitute cancellation of your contract.
- Additional work outside your package is billed at £50 per hour.
5. Client Responsibilities
- You must provide all required content (text, images, media) promptly.
- A single point of contact must be appointed for all communications.
- Failure to provide content may cause delays but will not affect billing.
6. Ownership and Access
Websites
- All websites remain the property of Cre8ive Works Ltd.
- After 12 months, you may move to a hosting-only plan (£25 per month / £260 per year).
- You may transfer your domain name subject to payment of outstanding fees.
- For security and data protection reasons, we cannot provide direct login access to websites hosted on our platform.
Social Media
- Where we manage or update your social media accounts, you grant us permission to access and publish content on your behalf.
- All content created by Cre8ive Works Ltd (including graphics, written posts, video, and marketing materials) remains the intellectual property of Cre8ive Works Ltd, but will be published and displayed on your social media accounts as part of the service.
- You may use and display this content indefinitely on your own social media channels. However, content may not be reused, redistributed, or repurposed for other platforms or campaigns without our written consent.
- If your contract with us ends, previously published content will remain on your accounts, but new content creation and account access will cease.
7. Late Payments
Invoices not settled within 30 days will incur a surcharge of 20% of the total outstanding balance or £40 (whichever is greater).
8. Additional Expenses
You agree to reimburse costs for any third-party resources required (e.g., stock imagery, premium plugins, or custom fonts). Payment is required before purchase.
9. Browser Compatibility
Websites are designed to function with major modern browsers (e.g., Chrome, Edge, Firefox). We cannot guarantee compatibility with outdated or unsupported browsers.
10. Termination
- Termination must be made in writing with 30 days’ notice.
- Early termination requires payment of the outstanding 12-month contract balance.
- No refunds will be issued for payments already made.
- Canceling recurring payments or transferring of domains does not suffice as cancellation.
11. Liability
Our liability is strictly limited to the total charges paid for services under this agreement. We accept no liability for:
- Delays caused by third parties or lack of client input.
- Losses due to browser incompatibility or third-party actions.
- Loss of data following removal of content for unpaid accounts.
12. Copyright and Content
You retain ownership of content you supply. You are responsible for securing rights to third-party materials. By providing content, you grant us permission to use it for your website.
13. Design Credit
A discreet link to Cre8ive Works Ltd will appear in the footer of your website. We reserve the right to showcase your website in our portfolio.
14. Governing Law
These Terms and Conditions are governed by English law.
15. Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions remain in full effect.
